1. Agreement to Terms
By accessing our website at mercuryhydraulics.com or by engaging Mercury Hydraulics for repair, manufacturing, or related services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.
2. Services
Mercury Hydraulics provides hydraulic cylinder repair and rebuild, custom hydraulic manufacturing, tube and pipe bending, pressure testing and certification, seal replacement, and related industrial services. All services are subject to:
- Availability of parts and materials
- Technical feasibility as determined by our technicians
- Acceptance of the quoted price by the customer
- Payment terms as agreed upon at time of service
3. Estimates and Pricing
Written estimates are valid for 30 days from the date of issue. Verbal estimates are approximations only and are not binding. Final pricing may differ from estimates if:
- Additional damage is discovered during disassembly and inspection
- Required parts or materials change in price
- The scope of work changes at the customer's request
We will notify customers of any material changes to the estimated cost before proceeding with additional work.
4. Warranty
Mercury Hydraulics warrants its repair work against defects in workmanship for a period of one (1) year from the date of service completion, subject to the following conditions:
- The repaired component has been installed and operated in accordance with manufacturer specifications
- The failure is not caused by misuse, abuse, accident, contamination, or improper installation
- The component has not been modified or repaired by parties other than Mercury Hydraulics after our service
- The customer notifies Mercury Hydraulics of the defect within the warranty period
This warranty covers labor and parts supplied by Mercury Hydraulics. It does not cover consequential or incidental damages. Parts sourced and supplied by the customer are not covered under this warranty.
5. Customer-Supplied Parts and Equipment
Customers who supply their own parts or materials accept responsibility for the suitability and quality of those materials. Mercury Hydraulics is not liable for failures resulting from customer-supplied parts. Equipment left at our facility for repair is at the customer's risk; we are not responsible for loss or damage due to fire, theft, or acts of God, though we take reasonable precautions to secure all customer property.
6. Payment Terms
Payment is due upon completion of services unless otherwise agreed in writing. We accept cash, check, and major credit cards. For orders over $2,500, a deposit of up to 50% may be required before work begins. Accounts not paid within 30 days of invoice are subject to a 1.5% monthly finance charge. Mercury Hydraulics reserves the right to retain possession of repaired equipment until payment is received in full.
7. Shipping and Returns
For ship-in repairs, customers are responsible for all shipping costs to our facility. Return shipping costs are the customer's responsibility unless otherwise agreed. Mercury Hydraulics is not responsible for damage that occurs during transit. We recommend customers use appropriate packaging and insure shipments for the full value of the equipment.
8. Limitation of Liability
Mercury Hydraulics' total liability for any claim arising from our services shall not exceed the amount paid for the specific service giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages, including lost profits or business interruption, even if we have been advised of the possibility of such damages.
9. Governing Law
These Terms of Service are governed by the laws of the State of Florida. Any disputes arising from these terms or our services shall be resolved in the courts of Brevard County, Florida.
10. Website Use
The content on mercuryhydraulics.com is provided for informational purposes only. You may not reproduce, distribute, or create derivative works from our website content without our express written permission. We reserve the right to modify or discontinue any aspect of our website at any time without notice.
11. Changes to Terms
We reserve the right to modify these Terms of Service at any time. Changes are effective immediately upon posting to our website. Your continued use of our services after any changes constitutes acceptance of the new terms.
